The policy outlines the procedures upon which we will act in response to notices of alleged copyright infringement.

1. Notice of Infringing Material

If you believe that your copyright work has been copied in a way that constitutes copyright infringement and is accessible through our service, you may notify our Copyright Agent, providing the following information:

  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

If you, as the content provider, member, or user, believe that the material that was removed or to which access was disabled is either not infringing, or you believe that you have the right to post and use such material from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send us a counter-notice containing the following information:

  • Your physical or electronic signature.

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.

  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.

  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

In accordance with the DMCA and other applicable laws, Everhaven Securities has adopted a policy of terminating, in appropriate circumstances and at Everhaven Securities’ sole discretion, users who are deemed to be repeat infringers. Everhaven Securities may also at its sole discretion limit access to the Service and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
